GUY’S AIR CONDITIONING & HEATING does not collect personally identifiable information about individuals except when such individuals specifically provide such information on a voluntary basis. For example, such personally identifiable information may be gathered from a contest or sweepstakes registration, the registration process for subscription sites or services and in connection with content submissions, community postings (e.g., chat and bulletin boards), suggestions, voting/polling activities and transactional areas. Personally identifiable information on individual users will not be sold or otherwise transferred to unaffiliated third parties without the approval of the user at the time of collection. ‘Personal Information’ is information that individually identifies you, such as your mobile phone number or user/screen name, as well as any Personal Information that you choose to include in messages you send through the Service. Phone numbers collected for the purpose of SMS are not shared.
GUY’S AIR CONDITIONING AND HEATING reserves the right to perform statistical analyses of user behavior and characteristics in order to measure interest in and use of the various areas of the site and to inform advertisers of such information as well as the number of users that have been exposed to or clicked on their advertising banners. GUY’S AIR CONDITIONING AND HEATING will provide only aggregated data from these analyses to third parties. Also, users should be aware that GUY’S AIR CONDITIONING AND HEATING may sometimes permit third parties to offer subscription and/or registration-based services through a GUY’S AIR CONDITIONING AND HEATING site.
GUY’S AIR CONDITIONING & HEATING is not responsible for any actions or policies of such third parties and users should check the applicable privacy policy of such party when providing personally identifiable information.

FURTHERMORE, THESE GUY’S AC SMS TERMS AND CONDITIONS CONTAIN AN ARBITRATION CLAUSE AND CLASS ACTION WAIVER, WHICH AFFECTS HOW DISPUTES WITH GUY’S AC ARE RESOLVED. By signing up for one or more text messaging programs, you expressly consent to receive marketing or non-marketing text messages, as applicable, from GUY’S AC and others texting on its behalf, at the telephone number(s) that you provide. You may opt-out of these communications at any time. Consent to receive text messages is not a condition of any purchase.
Program Description
Guy’s AC text messages are intended to provide you with telecommunications assistance, marketing and promotional information regarding Guy’s AC products and services including events and promotions offered by Guy’s AC. We may also provide you with transaction-related information.
Message Frequency
The number of Guy’s AC text messages that you receive will vary depending on which Guy’s AC text messaging programs for which you sign up to receive messages and the frequency of the messages sent by those programs. Typically, users can expect an estimated daily volume of 1-200 messages, depending on the nature of the communications.
Cost
Message and data rates may apply to each text message sent or received in connection with Guy’s AC text messages, as provided in your mobile telephone service rate plan (please contact your mobile telephone carrier for pricing plans), in addition to any applicable roaming charges. Guy’s AC does not impose a separate fee for sending Guy’s AC text messages; however, you are responsible for any fees imposed by your mobile carrier of any kind whatsoever.
Donations
Guy’s AC does not currently solicit or receive any type of donations via SMS. If we decide to initiate a donation campaign in the future, it will be clearly stated and require explicit user consent.
How to Opt-In
To opt-in to receive text messages from a Guy’s AC text messaging program(s), please follow the instructions provided by the specific program from which you wish to receive messages. For example, you may be asked to reply in the affirmative in the manner indicated in an initial text message.
How to Opt-Out
To stop receiving text messages from a specific Guy’s AC text messaging program, text STOP to the five-digit short code for the text messaging program from which you no longer wish to receive messages. You acknowledge that you may then receive one (1) final message from Guy’s AC confirming your opt-out of that text messaging program. Following such confirmation message, no additional text messages associated with that program will be sent to you unless you re-activate your subscription. This will only opt you out of the specific text messaging program associated with that five-digit shortcode. You will remain opted into other Guy’s AC text messaging programs.
Your Mobile Telephone Number
You represent that you are the account holder for the mobile telephone number(s) that you enroll. You are responsible for notifying Guy’s AC immediately if you change your mobile telephone number. You may notify Guy’s AC of a number change by contacting Guy’s AC Support [email protected]. You agree to indemnify Guy’s AC in full for all claims, expenses, and damages related to or caused in whole or in part by your failure to notify Guy’s AC if you change your telephone number including, but not limited to, all claims, expenses, and damages related to or arising under the Telephone Consumer Protection Act.
Access or Delivery to Mobile Network is Not Guaranteed
It is your responsibility to determine if your mobile carrier supports text messaging and if your mobile device is capable of receiving text messages. Your receipt of our text messages is subject to the terms and conditions of your agreement(s) with your mobile carrier. Delivery of information and content to a mobile device may fail due to a variety of circumstances or conditions. You understand and acknowledge that network services, including but not limited to mobile network services, are outside of Guy’s AC’s control, and Guy’s AC is not responsible or liable for issues arising from such network services (e.g., delayed or undelivered messages or the security of any messages).
Eligibility
To receive Guy’s AC text messages, you must be a resident of the United States and 18 years of age or older. Guy’s AC reserves the right to require you to prove that you are at least 18 years of age.
Changes to Terms and Conditions
Guy’s AC may revise, modify, or amend these Guy’s AC’s SMS Terms and Conditions at any time. Any such revision, modification, or amendment shall take effect when it is posted to Guy’s AC’s website (https://www.guysac.com/). You agree to review these Guy’s AC SMS Terms and Conditions periodically to ensure that you are aware of any changes. Your continued consent to receive Guy’s AC text messages will indicate your acceptance of those changes.
Termination of Text Messaging
We may suspend or terminate your receipt of Guy’s AC text messages if we believe you are in breach of these Guy’s AC SMS Terms and Conditions. Your receipt of Guy’s AC text messages is also subject to termination in the event that your mobile telephone service terminates or lapses. Guy’s AC reserves the right to modify or discontinue, temporarily or permanently, all or any part of Guy’s AC text messages, with or without notice.
